Terms of Service

Welcome to Maple Ventures Tourism. These Terms of Service ("Terms") govern your access to and use of our website, products, and services. By accessing or using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

1. Acceptance of Terms

By accessing or using the Maple Ventures Tourism website, booking our services, or interacting with any of our platforms, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and any other guidelines, rules, or policies that we may publish from time to time.

2. Changes to Terms

We reserve the right to modify these Terms at any time at our sole discretion. Any changes will be effective immediately upon posting the revised Terms on our website. Your continued use of our services after such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for changes.

3. Eligibility

To use our services, you must be at least 18 years old or the age of legal majority in your jurisdiction, whichever is greater. By using our services, you represent and warrant that you meet these eligibility requirements. If you are using our services on behalf of a company, organization, or other entity, you represent that you have the authority to bind that entity to these Terms.

4. Account Registration

4.1 Account Creation

To access certain features of our services, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We cannot and will not be liable for any loss or damage arising from your failure to comply with these requirements.

5. Booking and Payment Terms

5.1 Booking Confirmation

All bookings are subject to availability. A booking is not confirmed until you receive a written confirmation from us and full payment or the required deposit has been received.

5.2 Pricing

All prices are quoted in Canadian dollars unless otherwise specified. Prices are subject to change without notice until payment is received in full. Published prices include applicable taxes unless otherwise stated.

5.3 Payment

Payment can be made by credit card, debit card, or other payment methods as specified during the booking process. By providing payment information, you represent and warrant that you are authorized to use the payment method and that the information you provide is accurate.

5.4 Deposits and Balance Payments

For certain bookings, a deposit may be required to secure your reservation. The balance payment must be made by the due date specified in your booking confirmation. Failure to pay the balance by the due date may result in cancellation of your booking and forfeiture of your deposit.

5.5 Fees and Charges

You are responsible for all fees and charges associated with your booking, including any booking fees, service charges, or taxes. Any additional services requested during your trip may incur extra charges.

6. Cancellation and Refund Policy

6.1 Cancellation by You

Cancellation policies vary depending on the type of service booked. Specific cancellation terms will be provided at the time of booking and in your booking confirmation. Generally:

  • Cancellations made 60 days or more before the departure date: Full refund minus a $100 administrative fee
  • Cancellations made 30-59 days before the departure date: 50% refund
  • Cancellations made less than 30 days before the departure date: No refund

6.2 Cancellation by Us

We reserve the right to cancel any booking due to circumstances beyond our control, including but not limited to natural disasters, political instability, or insufficient participation. In such cases, you will be offered a full refund or the option to reschedule for a later date. We are not responsible for any incidental expenses that you may have incurred as a result of your booking, such as visas, vaccinations, or non-refundable flights.

6.3 Changes by You

If you wish to make changes to your booking, please contact us as soon as possible. We will make reasonable efforts to accommodate your requests, but changes cannot be guaranteed and may be subject to additional charges.

6.4 Changes by Us

We reserve the right to make minor changes to your itinerary where necessary. In the event of a significant change to an essential term of your booking, we will notify you as soon as possible and offer you the choice of accepting the change, booking an alternative trip, or receiving a full refund.

7. Travel Documents and Requirements

7.1 Travel Documents

You are responsible for ensuring that you have all necessary travel documents, including but not limited to passports, visas, health certificates, and insurance. Your passport must be valid for at least six months beyond the duration of your trip.

7.2 Travel Insurance

We strongly recommend that you purchase comprehensive travel insurance that covers trip cancellation, medical emergencies, and baggage loss or damage. Travel insurance is not included in the price of our services unless explicitly stated.

7.3 Health Requirements

You are responsible for complying with any health requirements or recommendations for your destination, including vaccinations. We recommend consulting with a healthcare professional before traveling.

8. Code of Conduct

When using our services, you agree to:

  • Comply with all applicable laws and regulations
  • Respect the customs, cultures, and environments of the places you visit
  • Treat our staff, partners, and other travelers with courtesy and respect
  • Follow the guidance and instructions of tour leaders and guides
  • Not engage in any behavior that may cause distress, danger, or annoyance to others

We reserve the right to refuse service or terminate your participation in a tour if your conduct is deemed inappropriate or harmful.

9. Limitation of Liability

9.1 Disclaimer

To the maximum extent permitted by law, Maple Ventures Tourism disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. We do not guarantee that our services will be uninterrupted, secure, or error-free.

9.2 Limitation of Liability

To the maximum extent permitted by law, Maple Ventures Tourism, its affiliates, and their respective officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with these Terms or your use of our services.

In no event shall our total liability to you for all claims arising from or relating to these Terms or your use of our services exceed the amounts paid by you to Maple Ventures Tourism for the specific service giving rise to the liability during the twelve (12) months preceding the event giving rise to the liability.

9.3 Third-Party Providers

Maple Ventures Tourism acts as an agent for third-party service providers, including but not limited to hotels, airlines, transportation companies, and tour operators. We are not responsible for the acts or omissions of these third-party providers or for any loss, damage, injury, expense, or inconvenience caused by delays, cancellations, or changes in schedules.

9.4 Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from any cause beyond our reasonable control, including but not limited to natural disasters, adverse weather conditions, government actions, political unrest, labor disputes, or mechanical failures.

10. Intellectual Property

10.1 Ownership

All content on our website, including but not limited to text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Maple Ventures Tourism or its content suppliers and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

10.2 Limited License

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our services for personal, non-commercial purposes. This license does not include the right to:

  • Modify or copy our materials
  • Use our materials for any commercial purpose
  • Attempt to decompile or reverse engineer any software contained on our website
  • Remove any copyright or other proprietary notations from our materials
  • Transfer the materials to another person or "mirror" the materials on any other server

10.3 User Content

By submitting content to our website (such as reviews, testimonials, or photos), you grant Maple Ventures Tourism a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable right to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media.

11. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

12. Indemnification

You agree to indemnify, defend, and hold harmless Maple Ventures Tourism, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:

  • Your violation of these Terms
  • Your use of our services
  • Your violation of any rights of any third party
  • Your conduct in connection with our services

13. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use our services will immediately cease.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts located in Toronto, Ontario, and you consent to the personal jurisdiction of such courts.

15. Dispute Resolution

Any dispute arising out of or relating to these Terms or your use of our services shall be resolved through good faith negotiations. If such negotiations fail, the dispute shall be submitted to binding arbitration in accordance with the Arbitration Act of Ontario.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect and enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements or policies referenced herein, constitute the entire agreement between you and Maple Ventures Tourism regarding your use of our services and supersede all prior and contemporaneous agreements, representations, and understandings.
